Laplink Gold offers you a variety of reliable, easy-to-use options for connecting; simply choose the option that is appropriate for the resources available on your computer and the computer you want to connect to. To learn more about Laplink Gold, see the online User's Guide and Help. Using Laplink Gold to connect to another computer is easy. Depending on the resources available on your computer and the computer you want to connect to, you can connect using: · a modem · a Laplink serial, parallel (Windows 98 SE/Me only), or Universal Serial Bus (USB) cable · the Internet · a Novell (IPX) network · a TCP/IP network · a CAPI/ISDN 2.0 device · Dial Up Networking Once you're connected, you're ready to use Laplink Gold's powerful features. · Remote Control lets you use your computer to perform tasks on another computer. · Remote Desktop lets you utilize the Remote Desktop/ Terminal Services feature built into Windows XP Professional, Windows Server 2000, and Windows Server 2003. · File Transfer lets you move and copy files between computers utilizing a user-friendly, dual pane user interface. · File Synchronization simplifies the repetitive tasks necessary to keep files updated when you use two or more computers. New features include user interface improvements, expanded file transfer tools, better remote file management, enhanced security, and virus-checked file transfers. New Laplink USB 2.0 Cable The new Laplink USB 2.0 cable enables the fastest file transfers ever. In addition, Laplink Gold 12 includes a number of significant improvements to its file transfer features. Integration with Windows XP Remote Desktop and Windows Terminal Services Laplink Gold now enables you to access the Remote Desktop feature built into Windows XP and the Windows Terminal Services feature built into Windows Server 2000 and Windows Server 2003. Laplink Internet Laplink Internet lets you reliably and securely connect through firewalls and proxy servers with no changes to the firewall configuration. Integrated Active Directory Security Use your Windows network security (Microsoft Domain Authentication) to control access to Laplink Gold as an alternative to manually creating user profiles (Laplink Authentication). Users on Windows 2000 Active Directory networks can specify which domain users have access and which Laplink Gold features they can use. Integrated Laplink Antivirus Transfer files securely and safely knowing that each file is virus-checked. Laplink Gold now includes integrated Laplink Antivirus that removes viruses when possible and quarantines files that cannot be cleaned. (Laplink Antivirus updates for the first year are included at no additional cost.) User Interface Improvements Laplink Gold's new interface is instantly recognizable to Windows XP users. To use all of its features and services, Laplink Gold must be installed on all of the computers you want to connect. General requirements for each computer · NOTE: Laplink Gold 12 does not support Windows NT or Windows versions prior to 98 SE (e.g., Windows 95). However, you can use Laplink Gold 12 to connect to a computer running such older operating systems by installing Laplink Gold 11.5 on the older operating systems. Please contact customer service for information or visit www.laplink.com · Microsoft Windows 98 SE, Me, 2000, XP or Server 2003 · 133 MHz or higher Pentium-compatible CPU · At least 64 megabytes (MB) of RAM; more memory generally improves responsiveness · 30 MB of available hard disk space (for a complete installation) · CD-ROM or DVD drive · VGA or higher resolution monitor · Keyboard and mouse required Requirements for Dial-Up Networking communication · Guest computer: Dial-Up Networking feature of Windows installed, with a Dial-Up Networking connection to a dial-up server · Host computer: Running a dial-up server program, or accessible through a dedicated dial-up server that supports incoming Dial-Up Networking connections Requirements for modem communication · Windows 98 SE/Me: Windows- or Hayes-compatible modem · Windows 2000/XP/2003: Modem set up in Windows 2000/XP/2003 (with TAPI) Requirements for network communication · For IPX connections: Microsoft IPX-compatible protocol configured for a network adapter · For TCP/IP connections: Microsoft TCP/IP-compatible protocol configured for a network adapter 4 88006_signat_2.indd 6 8/23/04 6:40:51 PM Requirements for cable communication · For USB connections: A Laplink USB 2.0 cable or the Laplink USB 1.1 (gold colored) cable plus a USB port on each computer. Note: A Laplink USB 2.0 cable will work in a USB 1.1 port but it will work at USB 1.1 transfer speeds. · For serial connections: A Laplink serial cable and an RS-232 serial (COM) port on each computer. · For Parallel connections: A Laplink parallel cable and a parallel port on each computer. Supported on Windows 98 SE/Me only. Installing Laplink Gold To install Laplink Gold: 1 Insert the Laplink Gold CD-ROM in a CD-ROM drive or, if you downloaded Laplink Gold from the Web, doubleclick the LaplinkGold12.exe file in the folder where you downloaded Laplink Gold. 2 Click Install Laplink Gold, and follow the instructions on the screen. When prompted, enter your serial number and give the computer a name that clearly describes it. When starting Laplink Gold for the first time, you will be prompted for an activation code. You will also be given an opportunity to set up your Laplink Internet account. If you choose not to set up your Laplink Internet account immediately, you can do so later from within Laplink Gold. You will need to setup this account to easily access other computers across the Internet and through firewalls. (First year of Laplink Internet is included at no additional cost.) To set up your Laplink Internet account, please refer to the instructions included on page 9, Creating Laplink Internet Accounts. · NOTE: To purchase Laplink cables, visit www.laplink.com or call 800-LAPLINK. Requirements for CAPI 2.0/ISDN communication · An ISDN line and ISDN adapter with a CAPI 2.0compliant driver on both ends of the connection. · NOTE: If the Laplink Gold Welcome screen does not appear, open Windows Explorer and double-click Welcome.exe on the Laplink Gold CD-ROM. Requirements for Voice Chat (must be installed on each computer) · A sound card or sound device, speakers or headphones, and a microphone. (A full duplex sound card driver is recommended.) 5 88006_signat_2.indd 7 8/23/04 6:40:52 PM Getting started: setting security and allowing others to connect After you install Laplink Gold, you can make outgoing connections to other computers, but until you change your security settings, other computers cannot access yours except by using a cable (such as a USB cable). To allow incoming connections, change the security settings by creating one or more entries in the Log-in List, or by adding Users from your local Microsoft domain or by allowing public access. You can restrict user access as necessary, specifying who can connect to your computer and what they can see and do once connected. The safest way to allow incoming connections is to set up password-protected access through the Log-in List. However, you can also set up your computer as a public system, open to anyone who can connect. Allowing others to connect to your computer Laplink Gold supports two different ways of allowing controlled access to your computer: Laplink Authentication and Microsoft Windows Authentication. Both can be used at the same time. · Laplink Authentication involves creating a log-in list of user names and passwords. A log-in list is unique to the computer on which it is created and it cannot be exported or shared with other Laplink computers. Log-in lists are the best way of creating secure access for individuals. · Microsoft Windows Authentication is extremely useful for people who are on a Windows Active Directory Network. This feature allows you to give access to network users, so that users need only their network usernames and passwords to access the Laplink Gold functions of your computer. · NOTE: To set up security for cables, click the Enforce Security option on the Local Security tab. For more information, see the Online User's Guide and Help. To specify who can connect to your computer using Laplink Authentication: 1 Click on Security under the Options Menu. 2 On the General tab, select Log-in List Only (Protected System). 3 Click the Log-in List button, and then click the Add button. The Security Model screen appears. 4 Select Laplink Authentication and click OK. 5 On the General tab, type the log-in name and password the user must provide to connect to your computer. 6 Under Services, check the services that you want to make available to the user, such as Remote Control, File Transfer, and Print Redirection. 7 If you've checked Remote Control as an available service, check the appropriate options under Locking Permissions to indicate whether the user can blank your computer screen and disable its mouse and keyboard. 8 Specify any additional user access restrictions and preferences on the Folder Security and Modem Callback tabs. 9 Click OK to add this person to your Log-in List. A Laplink Gold 12 user can now connect to your computer by using the log-in name and password you specified. · NOTE: For more information about selecting options on the Folder Security and Modem Callback tabs, see the Online User's Guide and Help. 6 88006_signat_2.indd 8 8/23/04 6:40:52 PM To specify who can connect to your computer using Microsoft Windows Authentication: 1 Click on Security under the Options Menu. 2 On the General tab, click Log-in List Only (Protected System). 3 Click the Log-in List button, and then click the Add button. The Security Model screen appears. 4 Select Microsoft Windows Authentication and click OK. 5 On the General tab, select your domain from the drop-down domain list (your current domain will be selected by default). 6 Select Users from the Domain Users area and click the Add button to move them into the Selected area. 7 Under Services, check the services that you want to make available, such as Remote Control, File Transfer, and Print Redirection. 8 If you've checked Remote Control as an available service, check the appropriate options under Locking Permissions to indicate whether the users can blank your computer screen and disable its mouse and keyboard. 9 Specify any additional user access restrictions and preferences on the Folder Security and Modem Callback tabs. 10 Click OK to add the users to your Log-in List. A Laplink Gold 12 user can now connect to your computer by using their network log-in name and password. You can also open your computer to connections from any Laplink Gold 12 user if you choose. Though public users do not need to enter a password to access your computer, you can limit what they can see and do. To allow public access to your computer: 1 From the Laplink Gold 12 menu bar, select Options > Security. 2 On the General tab, click Anybody (Public System). 3 Click the Public Privileges button. 4 On the General tab, check the services and locking privileges you want to grant to public users. 5 To limit public access to particular drives and folders, click the Folder Security tab. 6 Click OK. 7 88006_signat_2.indd 9 8/23/04 6:40:53 PM Deciding how to connect Laplink Gold gives you a variety of options for connecting to another computer. To choose the appropriate option, determine what resources are available on the local and remote computers. Connecting from another Laplink computer over the Internet Can you connect to the Internet on the local computer? Yes Can you connect to the Internet on the remote computer? Yes Then connect to another Laplink computer over the Internet this way: Use Connect over Laplink Internet for simple, secure connections without the hassle of configuring ports or a firewall. Use Connect Over Dial-Up Networking to dial in to a network server and connect over the network's Internet connection. No, but I can connect to a network that has an Internet connection. Yes Connecting over modems, networks, and cables With this available on the local computer modem modem And this available on the remote computer modem modem and network Connect to another Laplink computer this way: Use Connect over Modem and dial in to the modem on the remote computer. Use Connect over Modem to connect directly to the remote computer and access all of the network resources available to that computer. Use Connect over Dial-Up Networking to dial in to the dial-up server and connect to any Laplink computer on the network. Use Connect over LAN (Network) Attach a Laplink parallel, serial, or USB cable to each computer. The connection opens automatically. Parallel port connections are available on Windows 98/Me only. modem network with a dial-up server network parallel, serial, or USB port network parallel, serial, or USB port 8 88006_signat_2.indd 10 8/23/04 6:40:53 PM Connecting through a firewall Laplink Internet ensures secure connections and requires no special configuration of firewalls. To use Laplink Internet, you must first create an account on the Laplink Internet server. (First year of Laplink Internet is included at no additional cost.) Once this is complete, you will be able to log-in from any Laplink Gold 12 computer and see any of your other computers that also have Laplink Internet accounts as long as they are running Laplink Gold 12 and are currently online and available for connections. Please Note. Now, you will need to associate the additional computer(s) to which you will want to connect using Laplink Gold 12. To add additional computer(s) to which you will want to connect: 1 Startup Laplink Gold 12 on the computer you want to add. 2 Click on "Yes" in the pop-up dialog box that automatically appears asking if you want to register with Laplink Internet. 3 You will be presented with a webpage. Click on "Click here to assign this PC to your account." 4 Enter your Username and Password plus a descriptive name for this PC. (This is the name that will appear in the Connect Over Laplink Internet dialog box). 5 Click on the Submit Button. You can now connect to and from the computers assocated to your account using Laplink Internet. Creating Laplink Internet Accounts To create a Laplink Internet account for the first computer to which you will want to connect: 1 You can set up your Laplink Internet account from the pop-up dialog box that appears automatically when you launch Laplink Gold 12. Simply click on "Yes" and follow the instructions presented. 2 Enter the Username and Password for your Laplink Internet account. Note: Your Laplink Internet Username and Password can be different than your Laplink Gold 12 Username and Password. 9 88006_signat_2.indd 11 8/23/04 6:40:54 PM Connecting to another computer To use all of the features in Laplink Gold 12, you must first connect to another computer that is also running Laplink Gold 12. Open the Shortcut Bar and make a selection from the Connect Over menu list, then provide the connection information. (You may use Laplink Gold 12 to connect to computers running older versions of Laplink, but not all connections and not all features will be available.) Important: Before you can connect to another computer, both computers must be running a version of Laplink, and the connection method you want to use (such as modem, cable or over a network) must be active and available. You may also need a valid Laplink Gold 12 log-in name and password in order to connect, unless public access has been enabled. Making a connection · NOTE: To determine the best way to connect to another computer, see Deciding how to connect. How your computer connects to another computer using Laplink Gold depends on the resources available to the two computers. Determine what types of connections each computer is able to make, and then select the appropriate connection option. To connect to another computer: 1 From the Connect Over menu, select a connection method: Modem: Use this method for modem-to-modem connections. Click Manual Dial and type the dialing information for the remote computer, or click an existing connection name. Click Dial. Dial-Up Networking: Use this method to connect to a network with a dial-up server using a modem. Click the Dial-Up Networking connection you want to use and choose the appropriate dial-up networking options. Click Dial to dial your modem. Once you've connected, you will be asked to specify which available computer on the network you want to connect to. LAN (Network): Use this method to connect to a computer on the same network. Choose a computer on the network by clicking the computer name. You can also connect to a computer by typing its TCP/IP address; click the TCP/IP Addresses tab, click Manual Connect, and type the TCP/IP address. Click OK. Laplink Internet: Use this method to connect to another computer running Laplink Gold 12 over the Internet. Using this service requires creating a Laplink Internet account. Cable (USB, Parallel, Serial): Use this method for computers connected by one of the Laplink cables (serial, parallel, or USB). The computer connected to your computer by cable is listed in the Connection list. Click the computer name and click OK 2 From the list of available computers, click on the one you want to connect to. 3 Under Services, check the services you want to open when you connect. (You must check at least one service.) 4 Click the OK button. 5 If prompted, type your Laplink Gold 12 log-in name and password. The connection is made, and the services you selected are opened if the remote computer is set up to allow you to access those services. 10 88006_signat_2.indd 12 8/23/04 6:40:54 PM Connecting with Laplink Gold 12 If the Shortcut Bar isn't visible Select Options>Shortcut Bar from the main menu then roll your mouse over the Shortcut Bar icon to display it, and select the connection type you want to use. · NOTE: If you can't connect, make sure that the other computer is running the appropriate version of Laplink, is set up to let you connect, and that the services you requested are allowed. For troubleshooting information, see the online user's guide or Help. The Connect dialog box looks different depending on the method you use to connect. Before you connect the computers with Laplink Gold using cables · Install and run Laplink Gold on both computers. · Attach an end of the Laplink cable to each computer. · Ensure that the proper port (serial, parallel, or USB) is enabled in Laplink Gold on both computers. To enable a port on a computer, click Options on the main menu, and then click Port Setup. Under Port Settings, highlight the port you want to enable, and then check the Enable Port box. · Attach cable · Start up Laplink Gold 12 Cables to use for Laplink connections For a serial, parallel, or USB cable connection, use a Laplink cable. Laplink cables are available at www.laplink.com or by calling (800) LAPLINK. If more than one type of cable port is available to you, remember that USB is the fastest. A USB cable can transfer data more than 500 times faster than a serial cable. In addition, you can attach a USB cable to any USB peripheral that incorporates a "hub" to which other devices can be connected. Using a hub allows you to use more than one USB-compatible device at a time. Connecting by Cable To connect two computers by a Laplink cable, attach the cable (serial, parallel, or USB) to both computers and start Laplink Gold on both computers. Choose the type of cable--serial, parallel, or USB-- based on the cables and ports you have available and the operating systems running on each machine. Ports are the connectors to which you attach cables and peripherals (like printers and external modems). To find out which types of ports are available on the computers you want to connect, consult the documentation or Windows Device Manager for each computer. Once you decide which type of cable connection you will use, attach a Laplink cable to each computer. Attach a Laplink serial cable to a serial port on each computer, a Laplink parallel cable (Windows 98 SE/Me only) to a parallel port on each computer, or a Laplink USB cable to a USB port or USB "hub" device on each computer. 12 88006_signat_2.indd 14 8/23/04 6:40:55 PM Connecting to another computer by cable When you launch Laplink Gold on two computers that are connected by a cable, Laplink Gold connects the computers automatically. If necessary, you can also open a cable connection to another computer manually. To manually connect to another computer by cable: 1 Go to the Connect Over option on the Shortcut Bar menu. 2 Select Connect over... > Cable (USB, parallel, serial). 3 In the Connection list, select the name of the computer you want to connect to. 4 Under Services, check the services you want to use. 5 Click OK. Session Tasks Once you have connected the two computers you can then use the other features and capabilities of Laplink Gold 12. Move files between computers, keep specific files synchronized, or sync whole directories. Schedule automated synchronization or file transfers. Assume control of another computer running Laplink. Use Laplink to talk over all connectivity methods supported by Laplink Gold. Open a Text Chat session with another computer running Laplink. Print documents from a remote computer to a local printer, or print documents from the local computer to a remote printer. Open a Windows Remote Desktop session with another computer running Laplink Gold 12. To learn more about Laplink Gold features, see the online user's guide and Help system. 13 88006_signat_2.indd 15 8/23/04 6:40:56 PM · NOTE: Laplink Antivirus updates for the first year are included at no additional cost Controlling the remote computer with Remote Control and Remote Desktop Laplink Gold offers two remote control options which let you use your computer to perform tasks on another computer: Laplink Remote Control and Remote Desktop. Laplink Remote Control allows you to connect to any computer with Laplink Gold including versions prior to Version 12. Remote Desktop is available only on Windows XP Professional, Windows Server 2000, Windows Server 2003 computers with Laplink Gold 12 installed. Windows XP Professional must be Configured to allow Remote Desktop Access. NOTE: You will be able to connect from any Guest computer running a Microsoft Windows version that is supported by Laplink Gold 12. However, you will only be able to connect to Host computers running either Windows XP Professional or Windows Server 2000 and 2003 with Terminal Services.For instructions, refer to "Set up this computer to use Remote Desktop" in Windows XP Professional Help and Support Center. Windows Server 2000 and Windows Server 2003 must have Terminal Services installed and running. Communicating over a Laplink Gold connection with Text Chat and Voice Chat Text Chat and Voice Chat let you communicate with someone at the other end of your Laplink connection. Text Chat lets you exchange typed messages with the other person, while Voice Chat lets you speak to the person. Protecting your computers with Laplink Antivirus Laplink Antivirus scans incoming and outgoing files transferred using Laplink Gold 12 for virus infection and will either delete or quarantine (based on your preference) the files it cannot clean. Transferring files and printing over a Laplink Gold connection Laplink Gold's file transfer features let you move files between computers, keep specific files synchronized between computers, or synchronize entire directories. You can also control whether a file will print on a remote or local printer regardless of whether the file itself resides on the local or remote computer. 14 88006_signat_2.indd 16 8/23/04 6:40:56 PM Laplink Software, Inc. License Agreement IF YOU BREAK THE SEAL OR OTHERWISE OPEN THE PACKAGE CONTAINING THE SOFTWARE PROGRAM MEDIA OR BY INSTALLING THE SOFTWARE, YOU ARE BY THAT ACT ACKNOWLEDGING THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US AND SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, BOTH ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT. YOU FURTHER AGREE THAT IF LAPLINK SOFTWARE INCORPORATED IS REQUIRED TO ENGAGE IN ANY PROCEEDING, LEGAL OR OTHERWISE, TO ENFORCE ITS RIGHTS UNDER THIS AGREEMENT, LAPLINK SOFTWARE INC. SHALL BE ENTITLED TO RECOVER FROM LICENSEE, IN ADDITION TO ANY OTHER SUMS DUE, REASONABLE ATTORNEY FEES, COSTS AND DISBURSEMENTS. OWNERSHIP OF SOFTWARE. You acknowledge and agree that all of the computer programs and associated documentation contained in this package (collectively, the "Software") are owned exclusively by Laplink Software and/or its licensors. The Software is protected under copyright and other intellectual property laws of the United States and international copyright treaties. You acknowledge and agree that the price paid by you for the Software is a license fee granting you only the rights set forth in this License Agreement. LICENSE. Laplink Software grants to you, and you accept, a limited, nonexclusive and revocable license to use the Software, in machine-readable, object code form only. You agree to use the Software only as authorized in this License Agreement. This License Agreement does not convey to you any ownership rights or any other interest in the Software. SCOPE OF LICENSE. You may not copy or make any changes or modifications to the Software, and you may not translate, decompile, disassemble, or otherwise reverse engineer the computer program(s). This is a single-user, multiple computer license, which means you are authorized to use the Software on up to a total of three (3) personal computers that are used exclusively by you (e.g., office, laptop and home). A valid license must be purchased for each person who will use the Software. You may only use the Software to link with a computer not used solely by you if the user of that computer has a valid license. If this software is to be installed on a network server, or more than one user can run the Software, you must purchase an additional license for each user or work station. Please contact the location where you purchased the Software and this license, or contact Laplink, to obtain additional licenses. You may not copy or make any changes or modifications to the Software, and you may not translate, decompile, disassemble, or otherwise reverse engineer the computer program(s). You may not loan, rent, lease or sublicense the Software or any copy to others for any purpose. You agree to use all reasonable efforts to protect the Software from unauthorized use, modification, reproduction, distribution or publication. You are not permitted to make any uses or copies of the Software that are not specifically authorized by the terms of this License Agreement, and Laplink reserves all rights that are not expressly granted to you. Your adherence to this License Agreement will allow Laplink to continue developing innovative and useful products and providing a high level of customer service and support. TERM. This license will become effective on the date you acquire the Software and will remain in force until terminated. You may terminate this license at any time by removing the Software from your computer and destroying the original Software and all copies. This license will automatically terminate if you breach any of the terms or conditions set out in this License Agreement. You agree to remove the Software from your computer, and either to destroy the original Software and all copies of the Software and documentation or to return them to Laplink Software, upon termination of this license for any reason. Additional charges may apply if file transfers using Laplink Internet Continually exceed 100 MB or more within 30 days at Laplink discretion. TRANSFER. You may transfer your license of the Software to another party by transferring the original program media and all applicable documentation, including the original of this License Agreement, to the recipient, who agrees to the terms of this Agreement. All other copies of the Software must be deleted and/or destroyed. Any transfer of possession of the Software terminates your license and all associated benefits under this License Agreement. You must notify Laplink in writing of such a transfer. Archival Copy. You may make one copy of this Software and associated documentation solely for backup or archival purposes. Alternatively, you may transfer this Software to a single hard disk drive, provided that you keep the original program media and accompanying documentation in your possession for backup or archival purposes. Any such copies of the Software or documentation shall include Laplink's copyright and other ownership notices. No other copies of Software or documentation may be made by you or any person under your authority or control. 15 88006_signat_2.indd 17 8/23/04 6:40:56 PM LIMITED WARRANTY. Laplink warrants the physical program media, physical documentation, and physical file transfer cable to be free from defects in materials and workmanship for a period of 30 days from the date of your purchase. If you notify Laplink of defects in materials or workmanship during the warranty period, Laplink will replace the defective program media or documentation or, at its option, refund the purchase price. Your remedy for breach of this warranty shall be limited to replacement or refund and shall not encompass any other damages. No dealer, distributor, agent or employee of Laplink is authorized to make any modification or addition to the warranty and remedies stated above. LAPLINK SOFTWARE SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LAPLINK SOFTWARE DOES NOT WARRANT THE PHYSICAL PROGRAM MEDIA, CABLE, PHYSICAL DOCUMENTATION OR COMPUTER PROGRAM(S) OTHER THAN AS EXPRESSLY STATED ABOVE, NOR DOES LAPLINK SOFTWARE PROVIDE ANY WARRANTY AS TO THE OPERATION OF THE SOFTWARE OR ITS FITNESS FOR ANY PARTICULAR APPLICATION, USE, OR PURPOSE. LIMITATION OF LIABILITIES AND REMEDIES: IN NO EVENT SHALL LAPLINK SOFTWARE OR ITS LICENSORS HAVE ANY LIABILITY FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR SPECIAL DAMAGES, WHATSOEVER, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE ARISING OUT OF THIS AGREEMENT, THE LICENSING OF SOFTWARE BY LAPLINK SOFTWARE OR THE PROVISION OF MAINTENANCE AND SUPPORT SERVICES BY LAPLINK, EVEN IF LICENSEE HAS ADVISED LAPLINK SOFTWARE OF THE POSSIBILITY OF SUCH DAMAGES, AND INCLUDING UNDER ANY CLAIM OF NEGLIGENCE, STRICT LIABILITY, DESIGN DEFECT,OR OTHER THEORY. IN NO EVENT SHALL THE LIABILITY OF LAPLINK SOFTWARE OR ITS LICENSORS EXCEED THE PURCHASE PRICE PAID FOR THE SOFTWARE, LESS ALL APPLICABLE TAXES AND DUTIES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATIONS OF LIABILITIY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE AFOREMENTIONED LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. U.S. GOVERNMENT RESTRICTED RIGHTS. The Software is provided with Restricted Rights. Use, duplication, or disclosure by the United States Government is subject to restrictions set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable. This license and your right to use this software shall automatically terminate if you fail to comply with any provision of this license and warranty agreement. MISCELLANEOUS. Unless otherwise restricted by law, you agree that this License Agreement shall be construed, interpreted and governed by the laws of the State of Washington of the United States of America, without regard to the laws governing conflicts of law. If any action is brought by either party against the other regarding any subject matter of this License Agreement, the prevailing party shall be entitled to recover, in addition to any other relief granted, reasonable attorney fees and expenses of litigation. You further agree that any claim relating to this License Agreement shall be brought in the courts of competent jurisdiction in the State of Washington. If any term of this License Agreement is declared void or unenforceable by any court of competent jurisdiction, enforcement of the remaining terms shall not be affected. No waiver of any right under this License Agreement shall be effective unless in writing and signed by both parties. No waiver of any past or present right arising from any breach or failure to perform shall be deemed to be a waiver of any future right arising under this License Agreement. This License Agreement sets forth the entire agreement between Laplink and you with respect to all matters covered herein.
