This booklet contains important information on the correct use of your Cartrek 200. Read this information carefully before using your navigation solution. First time use of your navigation solution Make sure your device is powered and the SD memory card is inserted correctly into the SD slot of your Cartrek 200. Also, make sure that the SD card is NOT locked (slider at the left side of your SD card). Carefully read the hardware manual of the Cartrek 200. Navigation solutions are based on digital maps. These digital maps are created with great care. However, actual situations such as one-way streets, street names, traffic signs etc change on a regular basis. Navigation systems can not take into account all these changes immediately. Therefore, you must always follow the local traffic rules. Neither CosmicNavigation BV, (partner) nor any other party can be held responsible for inconsistencies in the navigation solution. Select the language you want to use. The language selection defines the language of the voice instructions and the language of the instructions that you see on the screen. You can change the language of your application in the options menu of your Cartrek 200 solution. Once you have selected a language, your Cartrek 200 navigation solution will start automatically. When your Cartrek 200 is ready for navigation, you will see the navigation menu. Click on `Routing' to enter your destination and start the navigation. Select `Routing'. 2 Cartrek 200 (your logo) Select the region to which you want to plan a route. Click on `Next'. Enter the city name by clicking on the keyboard. You will notice that only these characters will remain visible that can be entered in combination with the characters that you already entered. Once you have selected the city, click on `Next'. If there are multiple city names that match the characters that you have already entered, you will be able to select the correct city from a list. You can browse the list by clicking on the up/down buttons at the lower part of the screen. Once you have entered the street name, click on `Next'. If you do not enter a street name and click on `next', you will be routed to the city centre of the selected city. You have the possibility to enter the house number. This is optional. You do not need to enter a house number. Click on the `Next' button to start the navigation. If you want to store the address as a favourite destination, click on `Favourite'. You can also see the destination on the map by clicking on `Map'. Follow the audio instructions and follow the coloured line on your Cartrek 200 screen. Drive safely! If you click on the textual instructions, the last audio command will be repeated. If the selected street is closed for traffic, you will be guided to the nearest open street. Important: GPS signals can only be received in your car or outdoors. Inside buildings or covered places, you will not be able to receive GPS signals. Cars with shielded windows will have limited GPS reception. An optional external GPS antenna can resolve this problem. 3 Cartrek 200 (your logo) More options for the selection of your destination If you tap on the map, the Quickpick menu will open immediately. Click on `Routing' to set up the different possibilities to create routes. Click on this icon to plan a route to your home destination. If you did not save your home address earlier, you will be asked to enter your home address. You can save your current position as your home address, or you can enter a full address. Select a favourite destination to navigate to. You can add new favourites by entering an address and save the address as a favourite in the address confirmation window (see above). Select a destination from the routes that you have recently driven. Select a POI (Place of Interest) to navigate to. See below for more explanation. Once you have created a route, you can delete the route by clicking on this icon. If you want to enter a destination by postal code, click on `postal' (next to the address entry field). Enter the postal code and click on `next'. To select a POI as your destination, click on the POI icon. You can select a POI at your current position, at your destination (if a route is planned), along the route (if you have planned a route), or at a specific address. 4 Cartrek 200 (your logo) Once you have made a selection, click on the POI category that you want to find. Blocking routes To block routes, go to the Quickpick and click on . You will see a small map of the eBVironment around your car. To block or avoid a route, click on the street on the map and click on avoid to avoid the street during your current trip. You can also block roads. A blocked road will remain blocked till you unblock the road again. You can also block roads for 5 or 15 kilometres. This is useful if you want to block, for instance, highways. In the block list, you can see all the roads that you have blocked. You can unblock roads here. The options of your device In the Quickpick menu, click on To change the language of the application. If you change the language of the application, you will need to reset your Cartrek 200. To change the time zone of your device. These settings, in combination with the GPS time, define the clock of device. To adjust the route settings of your navigation solution. See below for more details. To adjust the screen settings of your device. See below for more details. To adjust the system options of your device. See below for more details. To adjust the audio volume of your device. 5 Cartrek 200 (your logo) In the route setting menu, you can change the route options: You can select the route type, the vehicle type and select the route options, such as avoiding ferry connections and highways. The default vehicle type is a car. If you want to use your navigation solution as a pedestrian or by bike, you need to change this setting. In the screen settings menu, you can change the settings of the screen: You can set your Cartrek 200 to automatically adjust the zoom level or your can set the zoom level manually. The map display can be shown in 2D (two dimensional) or 3D (three dimensional). You can also select which POIs should be displayed on the screen. Double tap on a POI category to make a POI visible or iBVisible. The Day/night toggle will change the colours of the screen to bright colours (during day) or darker colours (during night). If you set this toggle to automatically, the colours will change automatically when the sun sets or rises. The display mode defines if you see an arrow or a map display during navigation. In the system options menu, you can change the basic settings of your device. You can select which units your Cartrek 200 uses to indicate distance and speed. You can also change the keyboard layout: azerty/qwerty or an ABCD mode. If you click on GPS settings, you will see detailed information on the quality of the GPS reception. 6 Cartrek 200 (your logo) Overview of the main navigation screen When you are driving you will see the screen below. This screen contains useful information about your navigation solution. This CosmicNavigation License Agreement (`License') permits Licensee to use one (1) copy of the software package (`Software Package') enclosed with the License for its own internal purposes only. The Software Package includes software (`Software'), if applicable, and their respective documentation. This non-exclusive License, without the right to sublicense, grants to Licensee the right to install and use the Software on a single personal navigation device (PND). Neither concurrent use on two or more PNDs nor use in a local area network or other network (including but not limited to the Internet) is authorized without the advance written consent of Licensor and the payment of additional license fees. Subject to the foregoing, Licensee may not use the Software in a manner that allows other users than Licensee to use the Software. If Licensee has multiple Licenses for the Software, then, at any time, Licensee may have as many copies of the Software in use as Licensee has Licenses. 2. CosmicNavigation 's Rights. Licensee acknowledges that the Software consists of proprietary, unpublished products of CosmicNavigation , protected under copyright law and trade secret laws of general applicability of the U.S.A. and/or other countries. Licensee further acknowledges and agrees that all right, title and interest in and to the Software are and shall remain with CosmicNavigation . This Agreement does not coBVey to Licensee an interest in or to the Software, but only a limited right of use, revocable in accordance with the terms of this Agreement. CosmicNavigation reserves all rights not expressly granted to Licensee. The data used in combination with the Software Package are the property of a third party and are subject to terms and conditions of such third party. 3. Term. This License is effective upon Licensee's first use of the Software and shall continue until terminated. Licensee may terminate this Agreement at any time by returning the Software to CosmicNavigation . CosmicNavigation may terminate this Agreement upon breach by Licensee of any terms hereof. Upon such termination by CosmicNavigation , Licensee agrees to return immediately the Software to CosmicNavigation . 4. Other Restrictions. This License is Licensee's proof of a non-exclusive license to exercise the rights granted herein and must be retained by Licensee. Licensee may not rent, lease, or otherwise commercialize the Software in any manner. Licensee may not reverse engineer, decompile, or disassemble the Software, except to the extent that the foregoing restriction is expressly prohibited by applicable law. Licensee may not export the Software or the Hardware or transfer them to another who exports them in violation of applicable US law or other export laws and regulations. 5. Limited Warranty. CosmicNavigation warrants solely to Licensee that the Software shall perform substantially in accordance with the program specifications in effect at the time of delivery and shall be free from defects in materials and workmanship, when given normal, proper and intended usage, for a period of thirty (30) days from the date of delivery of the Software Package to Licensee. CosmicNavigation agrees to repair or replace at its option and without cost to Licensee, all defective Software Package components, provided that Licensee has given CosmicNavigation written notice of such warranty claim within such thirty (30) day warranty period. CosmicNavigation shall have no obligation to make repairs or replacements which are required by normal wear and tear, or which result, in whole or in part, from catastrophe, fault or negligence of Licensee, or from improper or unauthorized use of the Software Package (including any use by third parties and by Licensee's employees, consultants and agents who are not authorized users), or use of the Software Package in a manner for which it is not designed, or by causes external to the Software Package. No suit or action shall be brought against CosmicNavigation more than one (1) year after the related cause of action has occurred. Furthermore, CosmicNavigation grants to Licensee only such warranty on the Hardware, as it receives from its Hardware provider. 6. Limitation of Liability. IN NO EVENT WILL COSMICNAVIGATION BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, ECONOMIC OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PACKAGE, INCLUDING SOFTWARE, DOCUMENTATION, OR HARDWARE, IF APPLICABLE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO CASE SHALL COSMICNAVIGATION 'S LIABILITY EXCEED THE AMOUNT PAID BY LICENSEE FOR THE SYSTEM. Furthermore, CosmicNavigation explicitly states that Licensee should not operate the Software Package while its vehicle is in motion. Licensee must keep its attention focused on the road, road traffic and the operation of the vehicle. By using the Software Package, Licensee acknowledges that it releases CosmicNavigation , CosmicNavigation 's partners, employees and shareholders from any actions directly or indirectly related to the use and/or operations of the Software Package. 7. Remedies. A breach by Licensee will irrevocably harm CosmicNavigation and CosmicNavigation shall be entitled to injunctive and/or other equitable relief, in addition to other remedies afforded by law. 8. Governing Law. This Agreement shall be governed by the laws of Belgium. 9. Severability. Should any term of this Agreement be declared void or unenforceable by any court of competent jurisdiction, such declaration shall have no effect on the remaining terms hereof. 10. No Waiver. The failure of either party to enforce any rights granted hereunder or to take action against the other party in the event of any breach hereunder shall not be deemed a waiver by that party as to subsequent enforcement of rights or subsequent actions in the event of future breaches. 11. Restricted Rights. RESTRICTED RIGHTS: If this Product is acquired by or for the U.S. Government, then it is provided with Restricted Rights. Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 252.227-7013, or subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, or clause 18-52.227-86(d) of the NASA Supplement to the FAR, as applicable, or any successor regulations. The contractor/manufacturer is CosmicNavigation N.V., Vollickstraat 67, 1785 Brussegem, Belgium. 12. Register your CosmicNavigation GPS solution within 30 days of your purchase on www.CosmicNavigation .com/registration. If the product is still unregistered 30 days after purchase of the product, the purchaser can not benefit from technical support and access to the CosmicNavigation Auto Update Service. The serial number provided with this software is your personal serial number. If you hand it over to 3rd parties, you will be denied access to the CosmicNavigation Auto Update Service. 13. You are not allowed to use the application in combination with a back-end solution for track and trace. If you connect a back-end solution for track and trace to the CosmicNavigation GPS navigation application, an additional royalty fee for use of the map data will apply. Deze handleiding bevat belangrijke informatie over het gebruik van dit toestel. Lees deze informatie aandachtig door alvorens u uw navigatie-oplossing gebruikt. Eerste gebruik van uw Cartrek 200 Kijk na of uw Cartrek 200 gevoed wordt door de sigarettenaansteker van uw wagen. Plaats de SD geheugenkaart correct in het SD slot van uw Cartrek 200. Neem zeker ook de hardware handleiding van uw Cartrek 200 door indien u dit nog niet gedaan heeft. Bij het gebruik van een navigatie systeem dient u ten allen tijde de actuele verkeerssituatie en bewegwijzeringen in acht te nemen. Hoewel de grootste zorg is besteed aan een actueel en nauwkeurig wegenbestand kan het gebeuren dat de kaartgegevens niet meer actueel zijn en de navigatie-instructies dientengevolge niet overeenkomstig de realiteit worden gegenereerd. Bij gebruik van de navigatieoplossing als wandelaar of fietser dient u de routeberekeningswijze overeenkomstig aan te passen. Zie "Meer mogelijkheden om een bestemming in te geven" onder instellingen. Kies de taal die u wenst te gebruiken. Deze keuze bepaalt de taal van de gesproken en visuele instructies van uw navigatie. U kan de taal altijd aanpassen via de optie-instellingen van uw Cartrek 200. Eenmaal u de taal geselecteerd heeft, zal de navigatie automatisch starten. Wanneer het GPStoestel operationeel is, zal u het navigatie menu zien. 9 Cartrek 200 (your logo) Klik op `Navigeer' om een bestemming in te geven en kies `adres'. Kies de regio waarnaar u een bestemming wil plannen (vb. Belgium) en klik daarna op `Volgende'. Geef de stadsnaam op door op de letters van het toetsenbord te klikken. Enkel die letters op het toetsenbord blijven zichtbaar, die in combinatie met de reeds ingegeven letters mogelijk zijn. Klik op `Volgende' eenmaal u de stad gekozen heeft. Indien er meerdere stadsnamen overeenkomen met de letters die u heeft ingegeven, kunt u de juiste kiezen uit de lijst. U kan de lijst doorzoeken met behulp van de Omhoog/Omlaag toetsen aan de onderkant van het scherm. Geef daarna op dezelfde wijze de straatnaam in. Als u geen straatnaam ingeeft en op `volgende' klikt, wordt u naar het centrum van de stad geleid. Nadien heeft u nog de mogelijkheid om een huisnummer in te geven. Dit is strict optioneel. Klik op `volgende' om de navigatie te starten. Als u de bestemming wil opslaan als een favoriete bestemming, klikt u op `Favoriet'. Luister naar de stembegeleiding en volg de gekleurde lijn op het scherm van uw Cartrek 200 . Rij voorzichtig en respecteer de plaatselijke verkeersregels! Als u op de tekstuele aanduiding klikt, wordt het laatste audio bevel herhaald. Indien de straat gesloten is voor doorgaand verkeer, zal u naar de meest nabije `open' straat geleid worden. 10 Cartrek 200 (your logo) Belangrijk: GPS-signalen kunnen enkel buiten of in wagens ontvangen worden. Het is niet mogelijk om binnen of in overdekte garages bijvoorbeeld GPS-signalen te ontvangen. In wagens met een filter in de voorruit kan het zijn dat er slechts een beperkte GPS-ontvangst is. Een optionele externe GPS-antenne kan hier een oplossing zijn. Meer mogelijkheden om een bestemming in te geven Als u eenmaal in de kaart klikt, verschijnt het Quickpick menu. Klik op `Routing' om de verschillende navigatie-instellingen te wijzigen. Een route naar uw thuisadres berekenen. Als u nog geen thuisadres heeft ingesteld, zal u gevraagd worden om er nu een in te geven. U kan uw huidige locatie als thuisadres instellen, of een volledig adres ingeven. Een favoriete bestemming selecteren. U kan nieuwe `Favorieten' toevoegen door een adres in te geven en op te slaan in het adres-venster (zie hierboven). Een bestemming selecteren uit de routes die u recent gereden heeft. Een POI (Place of Interest) selecteren om naar te navigeren. Zie hieronder voor meer informatie. De ingegeven route wissen. Als u een adres via postcode wil ingeven, klik bovenaan op `post'. daarna op `OK'. Geef de postcode in en klik 11 Cartrek 200 (your logo) Om een POI als bestemming te selecteren, klikt u op het POI icoon. U kunt een POI selecteren op uw huidige locatie, op uw bestemming (als u een route heeft berekend), tijdens de rit of op een specifiek adres. Wanneer een selectie heeft gemaakt, klikt u op de POI-categorie die u wil vinden. Straten blokkeren Om routes te blokkeren gaat u naar het Quickpick-menu and klikt u op . U ziet dan een kleine kaart van de omgeving rond uw wagen. Om een straat te blokkeren of te vermijden, klikt u op de straat, die tijdens uw huidige route wil vermijden en dan op "vermijden." U kunt een straat ook blokkeren: een geblokkeerde straat zal vermeden worden tot u de blokkering opheft. Ook kunt u wegen blokkeren voor 5 of 15 kilometer. Dit kan nuttig zijn indien u bijvoorbeeld snelwegen wil blokkeren. In de de blokkeerlijst ziet u alle geblokkeerde straten. Deze blokkeringen kunt u hier opheffen. 12 Cartrek 200 (your logo) De opties van uw toestel In het Quickpick-menu hebben deze iconen, de volgende functies: Instellen van de taal van de GPS-toepassing. Als u een andere taal kiest, moet u het toestel resetten, alvorens deze geactiveerd wordt. Instellen van de tijdzone. Op basis van deze keuze en de GPS-tijd, wordt de klok van het toestel ingesteld. Instellen van de routeringsopties van uw navigatietoestel. Zie hieronder voor meer informatie. Instellen van de schermopties. Zie hieronder voor meer informatie. Instellen van de systeeminstellingen. Zie hieronder voor meer informatie. Instellen van het geluidsniveau van uw toestel. In het routeringsmenu, kunt u volgende opties instellen: U kan het type route en voertuig instellen en de routeringsopties instellen, zoals het vermijden van ferry-verbindingen en snelwegen. Standaard is het toestel ingesteld voor gebruik in een personenwagen. Als u het toestel wil gebruiken als voetganger of fietser, kunt deze instelling hier aanpassen. In het scherminstellingsmenu kunt u deze opties instellen: U kunt uw Cartrek 200 instellen om automatisch het zoomniveau aan te passen, of u kunt het zoomniveau handmatig instellen. De kaart kan in 2D (tweedimensionaal) of in 3D (driedimensionaal) worden weergegeven. U kunt ook selecteren welke POIs moeten worden weergegeven op het scherm. Dubbelklik hiervoor op een POI-categorie om een POI zichtbaar of onzichtbaar te maken. De Dag/Nacht schakelaar past het kleurenschema van de kaart aan in een helder palet (overdag) of een donker palet ('s nachts). Als u deze optie op "automatisch" instelt, worden de kleuren automatisch aangepast bij zonsopgang en zonsondergang. De beeld modus bepaalt of een pijl of een kaart ziet tijdens de navigatie. 13 Cartrek 200 (your logo) In het systeeminstellingsmenu, kan u de systeeminstellingen van uw Cartrek 200 wijzigen. U kan instellen welke eenheden uw Cartrek 200 gebruikt om afstand en snelheid uit te drukken. U kan ook de indeling van het toetsenbord instellen: azerty/qwerty of een ABCD-modus. Als u op `GPS-instellingen' klikt, ziet u gedetailleerde informatie over de GPS-ontvangst. 14 Cartrek 200 (your logo) Overzicht van het navigatie scherm Eenmaal u rijdt, zal u het onderstaande scherm te zien krijgen. Dit scherm bevat zeer nuttige informatie over de te rijden route. Totale afstand tot bestemming Verwachte aankomsttijd Uw snelheid Route die u moet volgen Uw positie Visuele aanduiding voor de volgende instructie Afstand tot de volgende instructie Aanduiding van de volgende instructie Gegevens voor contact & technische ondersteuning Als u vragen of opmerkingen heeft, laat het ons weten: Onze website: WWW.CARTREK.INFO 15 Cartrek 200 (your logo) Eindgebruiksersovereenkomst Dit is een rechtsgeldige overeenkomst tussen u (`de Licentiehouder') en CosmicNavigation N.V. (`CosmicNavigation '). Door het verzegelde Programmapakket te openen en/of het Programma te gebruiken, gaat u ermee akkoord gebonden te zijn door de bepalingen van deze Overeenkomst. Indien u niet akkoord gaat met de bepalingen van deze Overeenkomst, dient u het Programmapakket volledig en onmiddellijk terug te zenden naar de verdeler van de software. 1. Licentie. Deze licentieovereenkomst (`Licentie') staat de Licentiehouder toe één (1) kopie van het programmapakket (`het Programmapakket') te gebruiken. Deze niet-exclusieve Licentie, zonder het recht sublicenties te verlenen, verleent de Licentiehouder het recht het Programma te installeren en te gebruiken op één enkele computer die draait op een besturingssysteem waarvoor een geldige licentie is uitgereikt in combinatie met één (1) personal navigation device (PND). De oorspronkelijke gebruiker van die computer mag voor zijn of haar uitsluitend gebruik een tweede kopie van het Programma installeren, hetzij op een homecomputer, hetzij op een draagbare computer, maar de Licentiehouder mag slechts één (1) kopie tegelijk gebruiken. Indien de Licentiehouder met betrekking tot het Programma verscheidene licenties bezit, dan mag de Licentiehouder te allen tijde eveBVeel kopieën in gebruik hebben als hij licenties bezit. 2. Rechten van COSMICNAVIGATION . De Licentiehouder erkent dat het Programma, alle rechten, aanspraken en belangen met betrekking tot het Programma, eigendom zijn van COSMICNAVIGATION en dat het Programma beschermd is onder het auteursrecht, het octrooirecht en onder internationale verdragen ter zake. Deze Overeenkomst verleent de Licentiehouder geen eigendomsrecht op het Programma, maar enkel een beperkt gebruiksrecht, dat kan worden herroepen in overeenstemming met de bepalingen van deze Overeenkomst. 3. Termijn. Deze Licentie wordt van kracht op het ogenblik dat de Licentiehouder het Programma voor het eerst gebruikt en ze blijft van kracht tot op het ogenblik dat ze wordt beëindigd. De Licentiehouder kan deze Licentie te allen tijde beëindigen door het Programma terug te zenden naar COSMICNAVIGATION . COSMICNAVIGATION kan deze Licentie beëindigen ingeval de Licentiehouder één van de bepalingen ervan niet naleeft. In geval van een dergelijke beëindiging van deze Licentie door COSMICNAVIGATION gaat de Licentiehouder ermee akkoord het Programmapakket terug te zenden naar COSMICNAVIGATION . 4. Andere beperkingen. Deze Licentie vormt voor de Licentiehouder het bewijs van een niet-exclusieve licentie om de daarin verleende rechten uit te oefenen en moet door de Licentiehouder worden bewaard. De Licentiehouder mag het Programma niet verhuren noch in leasing geven. De Licentiehouder mag het Programma niet bewerken, decompileren noch veranderen, behalve voor zover de voornoemde beperking krachtens de geldende wetgeving uitdrukkelijk verboden is. 5. Beperkte garantie. Gedurende een periode van dertig (30) dagen vanaf de datum van levering van het Programmapakket aan de Licentiehouder garandeert COSMICNAVIGATION de Licentiehouder enkel en alleen dat het Programmapakket zal functioneren in overeenstemming met de programmaspecificaties, die ten tijde van de levering van toepassing zijn en vrij zal zijn van materiële gebreken en constructiefouten wanneer het normaal en op de juiste manier gebruikt wordt voor het gebruik waartoe het bestemd is. COSMICNAVIGATION gaat ermee akkoord alle gebrekkige componenten van het Programmapakket naar keuze en zonder kosten voor de Licentiehouder te herstellen of te vervangen, op voorwaarde dat de Licentiehouder binnen die garantietijd van dertig (30) dagen COSMICNAVIGATION schriftelijk van een dergelijke vordering in kennis heeft gesteld. COSMICNAVIGATION is er niet toe gehouden herstellingen of vervangingen uit te voeren die vereist zijn ten gevolge van normale slijtage, of die geheel of gedeeltelijk resulteren uit een oBVoorzienbare gebeurtenis, een tekortkoming of nalatigheid vanwege de Licentiehouder, of uit een incorrect of ongeoorloofd gebruik van het Programmapakket (met inbegrip van elk gebruik door derden en door de werknemers, consulenten en agenten van de Licentiehouder die geen gevolmachtigde gebruikers zijn), of uit een gebruik van het Programmapakket waartoe het niet bestemd is, of uit oorzaken die extern zijn aan het Programmapakket. 6. Beperking van de aansprakelijkheid. DE AANSPRAKELIJKHEID TEN OPZICHTE VAN DE LICENTIEHOUDER VOOR DE SCHADE TEN GEVOLGE VAN GELIJK WELKE OORZAAK, IS NOOIT HOGER DAN DE PRIJS DIE DOOR DE LICENTIEHOUDER VOOR DE LICENTIE VOOR HET GEBRUIK VAN DE SOFTWARE IS BETAALD. COSMICNAVIGATION IS IN GEEN GEVAL AANSPRAKELIJK VOOR SCHADE DIE VOORTKOMT UIT HET VERLIES VAN GEGEVENS, WINSTDERVING OF HET OBVERMOGEN GEBRUIK TE MAKEN VAN BEPAALDE APPARATUUR, DAN WEL VOOR SPECIFIEKE, TOEVALLIGE OF GEVOLGSCHADE, VOORTKOMEND UIT OF VERBAND HOUDEND MET HET GEBRUIK VAN OF DE PRESTATIES VAN DE SOFTWARE. Licentiehouders mogen het Programma niet gebruiken indien het voertuig in beweging is. Bestuurders moeten hun volledige aandacht op de weg, het verkeer en het besturen van hun voertuig behouden. Door het gebruik van de software vrijwaart Licentiehouder CosmicNavigation , partners, personeelsleden en aandeelhouders van CosmicNavigation van elke juridische actie die direct of indirect voortvloeit uit het gebruik van deze software. 7. Rechtsmiddelen. Ingeval de Licentiehouder deze Overeenkomst niet naleeft, is hij ertoe gehouden het Programmapakket onmiddellijk terug te zenden naar COSMICNAVIGATION . Elke contractbreuk door de Licentiehouder zal onherroepelijk schade berokkenen aan COSMICNAVIGATION en COSMICNAVIGATION zal gerechtigd zijn tot alle rechtsmiddelen bepaald bij de wet. 8. Geldende wetgeving. Deze overeenkomst wordt geregeld door de Belgische wetgeving. 9. Deelbaarheid. Ingeval een bepaling van deze overeenkomst door een bevoegde rechtbank nietig en niet afdwingbaar wordt verklaard, zal deze nietigheid geen weerslag hebben op de overige bepalingen van deze overeenkomst. Geen verklaring van afstand. Indien een van beide partijen nalaat de rechten die voortspruiten uit deze Overeenkomst af te dwingen, desnoods door een vordering, zal dit niet worden beschouwd als een afstand door die partij wat de latere afdwinging van rechten of de latere instelling van vorderingen in geval van toekomstige inbreuken op deze Overeenkomst betreft. 11. Vous pouvez aussi bloquer une route : une rue bloquée sera évitée jusqu'à ce que vous relever ce blocage. Vous avez aussi la possibilité de bloquer une route pour 5 ou 15 kilomètres. Ceci peut être utile si vous voulez éviter une autoroute par exemple. Dans la liste des blocages, vous verrez toutes les rues bloquées et vous pourrez les relever ici. Le Titulaire de licence reconnaît en outre et accepte que tous droits, titres de propriété et intérêts sur et dans le Logiciel sont et resteront la propriété de CosmicNavigation . Le présent Contrat ne cède au Titulaire de licence aucun intérêt sur ou dans le Logiciel, mais lui confère uniquement un droit d'utilisation limité, révocable conformément aux clauses du présent Contrat. 3. Durée. La présente Licence prend effet lors de la première utilisation du Logiciel par le Titulaire de licence et restera en vigueur jusqu'à sa résiliation. Le Titulaire de licence n'est pas autorisé à louer, céder en leasing ni à commercialiser le Logiciel de toute autre manière. Le Titulaire de licence ne peut désosser, décompiler ou désassembler le Logiciel, si ce n'est dans la mesure où la restriction ci-avant est expressément interdite par le droit applicable. Le Titulaire de licence ne peut exporter le Logiciel ou le Matériel ni les transférer à un tiers qui les exporterait en violation du droit américain applicable. 5. Limitation de garantie. CosmicNavigation garantit exclusivement au Titulaire de licence que le Logiciel fonctionnera conformément aux spécifications du programme en vigueur au moment de la livraison et sera exempt de tout défaut matériel et vice de fabrication, pour autant qu'il soit utilisé normalement, correctement et pour le but eBVisagé, durant une période de quatre-vingt-dix (90) jours à compter de la date de livraison du Logiciel au Titulaire de licence. CosmicNavigation s'engage à réparer ou remplacer gratuitement, à sa discrétion, tous composants défectueux du Progiciel pour autant que le Titulaire de licence ait notifié par écrit à CosmicNavigation ladite demande de garantie dans le délai de quatre-vingtdix (90) jours susvisé. CosmicNavigation ne sera nullement tenu de procéder à des réparations ou remplacements rendus nécessaires par l'usure normale, ou qui résulteraient, en tout ou partie, d'une catastrophe, d'une erreur ou négligence du Titulaire de licence, de l'usage incorrect ou non autorisé du Logiciel (y compris toute utilisation par des tiers et par des membres du personnel, consultants et agents du Titulaire de licence qui ne sont pas des utilisateurs autorisés), de l'utilisation du Logiciel d'une manière non conforme à l'usage prévu, ou de causes extérieures au Logiciel. Aucune poursuite ou action ne sera entamée ou intentée à l'encontre de CosmicNavigation plus d'un (1) an après la survenance de la cause de l'action. 6. Limitation de responsabilité. CosmicNavigation NE SERA EN AUCUN CAS TENU RESPONSABLE DE TOUS DOMMAGES INDIRECTS, SPECIAUX, FORTUITS, ECONOMIQUES OU CONSECUTIFS, RESULTANT DE L'UTILISATION OU DE L'INCAPACITE D'UTILISATION DU PROGICIEL, A L'INCLUSION DU LOGICIEL, DE LA DOCUMENTATION OU DU MICROPHONE, SI APPROPRIÉ, MEME SI ELLE ETAIT INFORMEE DE L'EVENTUALITE DE TELS DOMMAGES. LA RESPONSABILITE DE CosmicNavigation N'EXCEDERA EN AUCUN CAS LE MONTANT PAYE PAR LE TITULAIRE DE LICENCE POUR LE SYSTEME. Recours. En cas de violation du présent Contrat par le Titulaire de licence, celui-ci retournera immédiatement le Logiciel et le Matériel à CosmicNavigation . Une violation dans le chef du Titulaire de licence causera un préjudice irrévocable à CosmicNavigation et CosmicNavigation aura droit à une compensation formelle et/ou en équité, sous réserve de tous autres recours prévus par la loi. 8. Droit applicable. Le présent Contrat sera régi par le droit de la France/Bélgique. 9. Séparation des clauses. La nullité ou l'inapplicabilité de l'une quelconque clause du présent Contrat déclarée par tout tribunal compétent n'hypothéquera nullement la validité des autres clauses. 10. Abandon. Le défaut de l'une des parties d'exiger l'application des droits concédés en vertu des présentes ou de prendre des mesures à l'encontre de l'autre partie en cas de manquement de cette dernière ne sera nullement considéré comme une renonciation, dans le chef de ladite partie, à faire appliquer les droits par la suite ou à prendre des mesures en cas de manquements ultérieurs. 11. Es ist aber unmöglich in diesen Dateien alle neue Änderungen in der Verkehrslage, wie neue Einbahnstraßen und Straßnamen, aufzunehmen. Folgen Sie der AudioWegweisung und der farbig angezeigten Strecke auf dem Bildschirm Ihres Cartrek 200 . Fahren Sie vorsichtig! Wenn Sie auf den textlichen Anweisungen anklicken, wird der letzte Audiobefehl wiederholt werden. Mit dem Öffnen des versiegelten Softwarepakets und/oder durch die Verwendung der Software erklären Sie sich bereit, die Vertragsbedingungen einzuhalten. Falls Sie mit den Bestimmungen dieses Vertrags nicht eiBVerstanden sind, senden Sie die Software mit allem Zubehör uBVerzüglich zurück an Ihren Händler. 1. Lizenzerteilung. Mit diesem CosmicNavigation Lizenzvertrag ("Lizenz") wird dem Lizenznehmer die Genehmigung für die interne Nutzung eines (1) Exemplars des der Lizenz beiliegenden Softwarepakets ("Softwarepaket") erteilt. Das Softwarepaket enthält die Software ("Software") sowie die Dokumentation. Diese einfache Lizenz enthält keine Berechtigung zur Vergabe von Unterlizenzen. Sie berechtigt dazu, die Software auf einem Einzelrechner mit einem ordnungsgemäss lizenzierten Betriebssystem zu installieren und zu nutzen. Weder die gleichzeitige Nutzung auf zwei oder mehr Rechnern noch die Nutzung in einem lokalen oder sonstigen Netzwerk (einschliesslich das Internet) ist ohne die vorherige schriftliche Genehmigung von CosmicNavigation und die Zahlung zusätzlicher Lizenzgebühren zulässig. Entsprechend darf der Lizenznehmer die Software auch nicht auf eine Weise einsetzen, durch die es neben dem Lizenznehmer und seinen Mitarbeitern oder anderen Anwendern ermöglicht wird, die Software zu nutzen. Der Hauptnutzer des Rechners, auf dem die Software installiert ist, darf eine zweite, ausschliesslich für den eigenen Gebrauch bestimmte Kopie der Software auf einem Heimcomputer bzw. einem tragbaren Rechner installieren, er darf jedoch jeweils nur eine (1) der Kopien gleichzeitig nutzen. Falls der Lizenznehmer über mehrere Lizenzen für die Software verfügt, darf er stets so viele Kopien der Software nutzen, wie er Lizenzen hat. 2. Rechte von CosmicNavigation . Der Lizenznehmer erkennt an, dass die Software aus urheberrechtlich geschützten, uBVeröffentlichten Produkten von CosmicNavigation besteht, die unter den Schutz des US-amerikanischen Urheberrechts sowie der allgemeinen Gesetzgebung zum Schutz von Geschäftsgeheimnissen fällt. Der Lizenznehmer erkennt des Weiteren an, dass alle Rechte, Anrechte und Ansprüche an der Software das Eigentum von CosmicNavigation sind und bleiben. Durch diesen Vertrag wird kein Anspruch an der oder auf die Software auf den Lizenznehmer übertragen, sondern lediglich ein eingeschränktes Nutzungsrecht erteilt, das in Übereinstimmung mit den Vertragsbedingungen wieder entzogen werden kann. 3. Laufzeit. Die Lizenz tritt mit der ersten Nutzung der Software durch den Lizenznehmer in Kraft und gilt bis zu ihrer Kündigung. Der Lizenznehmer kann den Vertrag jederzeit durch Rücksendung der Software an CosmicNavigation kündigen. CosmicNavigation kann den Vertrag im Falle von Verstössen gegen die Vertragsbedingungen seitens des Lizenznehmers kündigen. Der Lizenznehmer erklärt sich bereit, die Software bei einer Vertragsbeendigung durch CosmicNavigation an CosmicNavigation zurückzugeben. 4. Sonstige Einschränkungen. Diese Lizenz gilt für den Lizenznehmer als Nachweis einer einfachen Lizenz zur Ausübung der darin festgelegten Rechte und ist vom Lizenznehmer aufzubewahren. Der Lizenznehmer ist nicht berechtigt, die Software Dritten durch Vermietung oder Verpachtung zu überlassen oder auf andere Weise zu vermarkten. Der Lizenznehmer darf die Software nicht in ihre Teile zerlegen, dekompilieren oder auseinander nehmen, sofern diese Einschränkung nicht ausdrücklich durch geltendes Recht verboten ist. Der Lizenznehmer darf die Soft- oder Hardware nicht exportieren oder an einen Dritten übertragen, der sie entgegen geltender US-amerikanischer Gesetze exportiert. 5. Eingeschränkte Garantie. CosmicNavigation garantiert dem Lizenznehmer lediglich, dass das Softwarepaket den zum Zeitpunkt der Lieferung gültigen Programmspezifikationen entspricht und bei normalem, ordnungs- und bestimmungsgemässem Gebrauch innerhalb von neunzig (90) Tagen nach Auslieferung des Softwarepakets an den Lizenznehmer keine Material- und Verarbeitungsfehler aufweist. CosmicNavigation erklärt sich bereit, nach eigenem Ermessen und ohne Kosten für den Lizenznehmer alle schadhaften Komponenten des Softwarepakets zu reparieren oder auszutauschen, sofern der Garantieanspruch seitens des Lizenznehmers innerhalb der neunzig (90) tägigen Garantiefrist schriftlich bei CosmicNavigation geltend gemacht wurde. CosmicNavigation ist nicht verpflichtet, Reparatur- oder Austauscharbeiten durchzuführen, die auf normalen Verschleiss zurückzuführen sind bzw. ganz oder teilweise durch einen Katastrophenschaden, ein Verschulden oder eine Fahrlässigkeit des Lizenznehmers, unsachgemässen oder unzulässigen Gebrauch des Softwarepakets (einschliesslich der Verwendung durch Dritte sowie Mitarbeiter, Berater und Vertreter des Lizenznehmers, die keine autorisierten Anwender sind) bzw. durch die Verwendung des Softwarepakets auf eine nicht bestimmungsgemässe Weise oder durch nicht auf dieses selbst zurückzuführende Ursachen entstanden sind. Nach Ablauf eines (1) Jahres nach dem Auftreten des entsprechenden Vorkommnisses kann keine Klage oder Forderung mehr gegen CosmicNavigation erhoben werden. 6. Haftungsbeschränkung. Anwendbares Recht. Dieser Vertrag unterliegt den Gesetzen der Bundesrepublik Deutschland. 9. Teilbarkeit. Sollte eine Klausel dieses Vertrags von einem zuständigen Gericht für nichtig oder nicht einklagbar erklärt werden, so bleiben alle übrigen Vertragsbedingungen davon unberührt. 10. Kein Verzicht.
